## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Competition & Consumer Law (ACCC / ACL)](https://ailawframework.com/practice/competition-and-consumer-law.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | From the signed deal steps and the waiver or notification status the lawyer identifies, list what has and has not been lodged and whether a decision date is recorded. Do not write the advice and do not say that the acquisition may complete. |
| What the lawyer must review | The lawyer advises whether the acquisition may complete. The ACCC says businesses must receive approval or a notification waiver before an acquisition that must be notified can proceed. If a waiver is refused and the thresholds are met, a notification must be lodged and approval obtained first. A waiver does not remove section 50. The lawyer confirms the thresholds, exemptions and any waiver or determination against the current instrument before giving that advice. |

## Checking plan

**Lawyer-led judgement**

The lawyer makes the substantive assessment. Any permitted AI assistance remains supporting work with its own checks.

- What the AI does: From the signed deal steps and the waiver or notification status the lawyer identifies, list what has and has not been lodged and whether a decision date is recorded. Do not write the advice and do not say that the acquisition may complete.
- What the lawyer does: The lawyer advises whether the acquisition may complete.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court or regulator classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.
- Restriction: The lawyer makes the substantive assessment. Any permitted AI assistance remains supporting work with its own checks.

## Checks the lawyer makes

1. Confirm from the portal record, not from instructions alone, whether a waiver or a notification has been lodged and decided.
2. State that section 50 still applies where a waiver has been granted.
3. Do not advise that completion may proceed on the strength of a fee payment or a draft application.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
