| How AI is used | From the court record, record whether the dismissal is of the whole action or a claim, whether the opposing party has served an answer or a motion for summary judgment, whether all parties who have appeared will sign a stipulation, and whether a counterclaim has been pleaded. Do not draft the notice. |
| What the lawyer must review | You decide whether Rule 41 allows a dismissal without a court order, whether a court order is required, and what prejudice and costs follow, and you prepare the notice or the stipulation. Subject to Rules 23(e), 23.1(c), 23.2, and 66 and any applicable federal statute, the plaintiff may dismiss without a court order by a notice filed before the opposing party serves an answer or a motion for summary judgment, or by a stipulation signed by all parties who have appeared. Unless the notice or stipulation states otherwise, the dismissal is without prejudice, but a second notice of dismissal of the same claim operates as an adjudication on the merits. Any other dismissal at the plaintiff's request is by court order, on terms the court considers proper. If the defendant has pleaded a counterclaim before being served with the motion to dismiss, the action may be dismissed over objection only if the counterclaim can remain pending for independent adjudication. Rule 41 also applies to dismissal of a counterclaim, crossclaim, or third-party claim. If the plaintiff later files again on the same claim against the same defendant, the court may order payment of the costs of the dismissed action and may stay the new action until payment. ## Checking plan

- What the AI does: From the court record, record whether the dismissal is of the whole action or a claim, whether the opposing party has served an answer or a motion for summary judgment, whether all parties who have appeared will sign a stipulation, and whether a counterclaim has been pleaded. Do not draft the notice.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- A notice of dismissal is available only before an answer or a motion for summary judgment. After that, dismissal is by stipulation or by court order.
- Rule 41(a) is subject to Rule 23(e). Dismissing a certified class claim, or a claim of a class proposed to be certified for settlement, needs the court's approval.
- State voluntary-dismissal rules differ, including on whether a dismissal is with prejudice.
