## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Climate, ESG & Sustainability Reporting](https://ailawframework.com/practice/climate-esg-and-sustainability-reporting.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | List each environmental claim, where it appears, and the test, study or record cited for it. Write no advertisement, label or qualification. |
| What the lawyer must review | The Green Guides, 16 C.F.R. Part 260, state the Federal Trade Commission's views on environmental marketing claims that can be unfair or deceptive under section 5 of the FTC Act, 15 U.S.C. § 45. They do not bind the public, and the Commission must still prove a violation. Section 260.2 says marketers need a reasonable basis before making a claim, and that in this context a reasonable basis often requires competent and reliable scientific evidence. Section 260.3 says qualifications should be clear, prominent and understandable, a claim should make clear whether it refers to the product, the package, a service or only a portion, and a claim should not overstate a negligible benefit. You decide whether the evidence meets that basis. The tool writes no claim. |

## Checking plan

- What the AI does: List each environmental claim, where it appears, and the test, study or record cited for it. Write no advertisement, label or qualification.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- General environmental-superiority claims such as 'environmentally preferable' are treated as difficult to substantiate unless clearly limited. See the examples in § 260.3.
- An SEC filing that repeats a marketing claim is a separate problem from the FTC guides. The 2024 climate rules are not the test. See the 29 May 2026 rescission proposal.
