## Checking plan

**Verify against sources**

Section 103R requires the court's approval and allows orders for distribution of settlement money. The lawyer checks each flagged claim against that approved scheme.

- What the AI does: Apply the court-approved scheme to each registered claim: check the scheme's criteria, calculate the entitlement by the scheme's formula, and flag missing evidence or a conflict. Do not approve a claim and do not add a percentage costs deduction unless the orders state one.
- What the lawyer does: The lawyer or the scheme administrator decides flagged claims and approves the schedule.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Section 103R: a representative proceeding may not be settled or discontinued without the court's approval. The court may make any orders it considers just for the distribution of money paid under the settlement or into court.
2. Use the scheme in those orders. Do not import a Victorian group costs order.
3. Practice Direction 8 of 2023 deals with notice of an application for approval of a settlement. Confirm the notice step the direction requires was followed before assessments are treated as final.
4. Flag a claim that does not meet the scheme's own proof requirements. Do not reject it in the tool.

## Notes

- No group costs order section was opened in the Civil Proceedings Act. Do not deduct a percentage unless the orders impose one.
- The lawyer approves the schedule. A submission filed for approval must meet the Queensland practice directions on accuracy of references.

## Practical guide

Jurisdiction: Supreme Court of Queensland, representative proceedings

**Deliverable**: A claim worksheet against the approved scheme, with flags and no payment approval.

**Inputs**

- Section 103R approval orders and the scheme
- Registration documents
- Any costs deduction the orders actually state

**Example**: Illustrative example: The court has approved a scheme that scores injury bands from the claimant's records. The worksheet applies that score and flags a claim with no record. It does not deduct a group costs percentage, because the orders do not state one.

**Stop and escalate when**

- There is no section 103R approval.
- A Victorian percentage is deducted without an order.
