| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | The tool writes nothing into the affidavit. It indexes the exhibits and annexures, compares the lawyer's draft against the proofing note and the source documents to list every fact with no source and every source not yet deposed to, and checks the document's form against the court's requirements. |
| What the lawyer must review | The lawyer takes the evidence, drafts it in the deponent's words, and confirms the deponent has read and adopted every paragraph before it is sworn. |

## Checking plan

**Lawyer-led judgement**

The lawyer makes the substantive assessment. Any permitted AI assistance remains supporting work with its own checks.

- What the AI does: The tool writes nothing into the affidavit. It indexes the exhibits and annexures, compares the lawyer's draft against the proofing note and the source documents to list every fact with no source and every source not yet deposed to, and checks the document's form against the court's requirements.
- What the lawyer does: The lawyer takes the evidence, drafts it in the deponent's words, and confirms the deponent has read and adopted every paragraph before it is sworn.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.
- Restriction: The lawyer makes the substantive assessment. Any permitted AI assistance remains supporting work with its own checks.

## Checks the lawyer makes

1. Confirm every paragraph is within the deponent's own knowledge, and that anything the deponent was told is identified as such with the source named.
2. Strip argument, conclusions about the child's best interests and characterisations of the other parent, and keep the deponent's account of what happened.
3. Check the exhibit index against the affidavit's references and against the actual annexures, and confirm the deponent can speak to every exhibit.
4. Confirm no subpoenaed, health, police or departmental record was put through a tool without the permission check, and that no placement address or carer identity appears.
5. Read the facts-needing-a-source list with the deponent and either obtain the source or remove the fact before the affidavit is sworn.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
