| How AI is used | List each report or record, its date, and the persons the file shows received a copy. Do not decide whether a recipient was allowed to have it. |
| What the lawyer must review | 42 U.S.C. § 5106a(b)(2)(B)(viii) calls for methods to preserve the confidentiality of all records in order to protect the rights of the child and of the child's parents or guardians, including requirements that reports and records made and maintained for the purposes of that subchapter and subchapter III shall only be made available to the categories in that clause. Those categories, as stated there, are individuals who are the subject of the report; Federal, State or local government entities, or their agents, as described in clause (ix); child abuse citizen review panels; child fatality review panels; a grand jury or court, upon a finding that information in the record is necessary for the determination of an issue before the court or grand jury; and other entities or classes of individuals statutorily authorized by the State pursuant to a legitimate State purpose. Clause (ix) requires disclosure to a government entity that needs the information to protect children from child abuse and neglect. You decide whether a recipient fits. This is a condition of a state grant. The state confidentiality statute is what you apply in the case. |

## Checking plan

- What the AI does: List each report or record, its date, and the persons the file shows received a copy. Do not decide whether a recipient was allowed to have it.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- Model Rule 1.6 is the lawyer's duty. Section 5106a is the grant condition on the agency's records. They are different duties.
- Clause (x) of the same provision addresses public disclosure of findings in a fatality or near fatality. Read it before anything from this file is released publicly.
- State law can be stricter than the federal list. Open the state statute before a record is shared.
