| How AI is used | Record which purpose in the permit rule the lawyer's note describes, the aircraft, and the flight. Do not say a permit may be issued and do not prepare an application. |
| What the lawyer must review | You decide whether to apply and you prepare any application. Section 21.197(a) says a special flight permit may be issued for an aircraft that may not currently meet applicable airworthiness requirements but is capable of safe flight, for these purposes: flying to a base for repairs, alterations, or maintenance, or to storage; delivering or exporting the aircraft; production flight testing of new production aircraft; evacuating aircraft from areas of impending danger; and conducting customer demonstration flights in new production aircraft that have satisfactorily completed production flight tests. Section 21.197(b) is a further permit for operation over the maximum certificated takeoff weight for flight beyond the normal range over water, or over land areas where adequate landing facilities or appropriate fuel is not available. The excess weight is limited to the additional fuel, fuel-carrying facilities, and navigation equipment necessary for the flight. Section 21.197(c) points the application for a continuing authorization to §§ 91.1017 and 119.51, which were not opened. The tool does not say the aircraft is capable of safe flight. A permit under this section is not a registration under § 47.3. Model Rule 1.4(b) is the explanation to the client. Formal Opinion 512 requires you to verify the note. |
