| How AI is used | From the institution's requests and the payment records, list each deposit, who was asked to pay, the due date, and any unpaid balance. Do not decide to suspend or terminate the arbitration. |
| What the lawyer must review | You decide whether to ask for any measure on nonpayment. Rule R-58 says the AAA requires advance deposits to cover the expense of the arbitration, including arbitrator compensation and expenses, renders an accounting, and returns any unexpended balance. Failure to deposit by the date the AAA sets may lead to the steps in Rule R-59. Rule R-59 says that if compensation, expenses, or administrative fees are not paid in full, the AAA may inform the parties so that one of them may advance the payment. To the extent the law allows, a party may request measures on nonpayment, which may include limiting a party's ability to assert or pursue its claim and prohibiting a non-paying party from filing any motion. In no event shall a party be precluded from defending a claim or counterclaim. The party opposing the request must have an opportunity to respond. If participation is limited, the claiming party who has paid must submit such evidence as the arbitrator requires for an award. The arbitrator, or the AAA if no arbitrator has been appointed, may suspend. If full payments are not made within the time provided after suspension, the arbitrator, or the AAA if none has been appointed, may terminate. That termination is for nonpayment after suspension. 9 U.S.C. § 2 is why a written agreement adopting these rules is enforceable. It does not itself require a deposit or authorize termination. |

## Checking plan

- What the AI does: From the institution's requests and the payment records, list each deposit, who was asked to pay, the due date, and any unpaid balance. Do not decide to suspend or terminate the arbitration.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- The opened PDF dates the Commercial Arbitration Rules as amended and effective 1 September 2022, and the Commercial Mediation Procedures as amended and effective 1 June 2026. Confirm the text in force when the demand or the mediation request was filed.
- A party is not precluded from defending a claim or counterclaim because a deposit is unpaid.
- Section 2 makes a written agreement to arbitrate enforceable. It does not itself set the procedure. The procedure is the one the agreement adopts.
