## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Arbitration & Alternative Dispute Resolution](https://ailawframework.com/practice/arbitration-and-alternative-dispute-resolution.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | For each factual sentence in the draft, list the document and page in the file that supports it, or mark that no document does. Write no sentence of the witness statement and no opinion of the expert. |
| What the lawyer must review | The lawyer writes any witness statement. The tool writes none of it, and it writes no outline of testimony. Federal Rule of Evidence 702: a witness qualified as an expert by knowledge, skill, experience, training, or education may testify in the form of an opinion if the proponent demonstrates it is more likely than not that the expert’s specialized knowledge will help the trier of fact, and the other conditions of the rule are met. The tool does not write those opinions. Formal Opinion 512 and Rule 1.6: drafts stay in a confidential tool, and the lawyer checks every match before the draft is settled. |

## Checking plan

- What the AI does: For each factual sentence in the draft, list the document and page in the file that supports it, or mark that no document does. Write no sentence of the witness statement and no opinion of the expert.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- A witness statement that will be signed or adopted is the lawyer’s work. The index is not a scaffold for it.
- Rule 702’s reliability conditions beyond the opening qualification are for the lawyer when an opinion is offered in court. The arbitration may adopt a different standard. No institutional expert rule was opened.
- A declaration under penalty of perjury, if one is used, is the witness’s statement. This version does not quote 28 U.S.C. § 1746 into the draft.
