## Key facts

| Fact | Value |

| Practice area | [Anti-Discrimination & Industrial Relations](https://ailawframework.com/practice/anti-discrimination-and-industrial-relations.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From pay and classification material the lawyer selects, build a comparison table across the occupations or industries the lawyer names, and list any fair work instrument, State industrial instrument, and annual wage review order the lawyer identifies. The tool does not decide that work is undervalued and does not write the application. |
| What the lawyer must review | The lawyer decides whether there is equal remuneration for work of equal or comparable value, who may apply, and writes any application. |

## Checking plan

**Source-by-source verification**

Trace relied-on content to independent sources and check for relevant material the output has missed.

- What the AI does: From pay and classification material the lawyer selects, build a comparison table across the occupations or industries the lawyer names, and list any fair work instrument, State industrial instrument, and annual wage review order the lawyer identifies. The tool does not decide that work is undervalued and does not write the application.
- What the lawyer does: The lawyer decides whether there is equal remuneration for work of equal or comparable value, who may apply, and writes any application.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. Limit applicants to an employee who would be covered, an employee organisation entitled to represent such an employee, or the Sex Discrimination Commissioner, unless the Commission is acting on its own initiative.
2. Record that a comparison need not be limited to similar work and need not be with a historically male-dominated occupation, and that a finding of gender discrimination is not required.
3. Include the annual wage review orders and the reasons for them as a mandatory consideration, and leave the order for the lawyer.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
