## How this work usually runs

Animal-law work arrives as a notice, a charge or a question asked before something is done. An owner receives a notice of intention to declare a dog dangerous or menacing and has a short time, seven days from the date of issue on the New South Wales page, to object. After a declaration, the keeping rules differ for a dangerous dog and a menacing dog, and they differ again between the Companion Animals Act 1998 and the Animal Management (Cats and Dogs) Act 2008. A cruelty charge is prosecuted under the animal-welfare statute of the place, in Victoria the Prevention of Cruelty to Animals Act 1986, by police or an authorised inspector who may also seize the animal. A breeder or a veterinary practice asks, before a procedure, whether docking, cropping, debarking or a similar step is prohibited. A keeper asks, before acquiring or moving a native animal, whether a wildlife licence is required at that place and at the other end of the trip. A producer walking stock asks whether the route needs a stock-route travel permit or a travelling-stock permit, and how many days ahead it must be lodged. An authorised officer may give a biosecurity direction about stock or a property, usually in writing, with a verbal direction confirmed in writing within seven days unless it has already been complied with. An owner who is unhappy with treatment lodges a complaint with the veterinary board for the place where the practitioner is registered, often only after a written approach to the practitioner.

## Why animal law is its own area

Prosecutions for cruelty, objections to dangerous and menacing dog declarations, wildlife licences, stock-route and travelling-stock permits, biosecurity directions about animals, and complaints to veterinary boards are a distinct practice. A farm biosecurity chronology and an export-permit checklist already live with agribusiness. This area starts from the animal, the notice and the licence.

## The Act is the Act of the place

Cruelty, dog declarations, wildlife licences and stock permits are State and Territory law. A keeper category approved for one place is not used in another. The Victorian cruelty elements and the Victorian prohibited-procedure list were the offence pages opened. They are not a national code. Each task names the page it was checked against.

## The objection, the advice and the complaint are the lawyer writing

An objection to a declaration, advice on a cruelty charge, advice on a prohibited procedure, and a complaint to a veterinary board are lodged or signed, or they are the advice itself. The tool can table dates and records. It does not write the client account of what happened and it does not write the document that is lodged.

## Read the notice for the time limit

The New South Wales dog page gives seven days from the date the council issues a notice of intention. A New South Wales travelling-stock permit needs at least two working days. A Queensland stock-route application is lodged at least seven days before travel. A verbal biosecurity direction is confirmed in writing within seven days unless it has already been complied with. The Queensland regulated-dog page that was opened does not state an objection period, so the period is taken from the notice and the Act.

## Jurisdiction notes

### United States

Local name: Animal welfare and wildlife

#### Animal Welfare Act

7 U.S.C. § 2131 states the congressional findings for the Animal Welfare Act. Congress finds that the regulated animals and activities are in interstate or foreign commerce or substantially affect it. The stated purposes are humane care and treatment of animals intended for research facilities, exhibition or use as pets; humane treatment during transportation in commerce; and protection of owners from theft by preventing the sale or use of stolen animals. The further finding is that it is essential to regulate the transportation, purchase, sale, housing, care, handling and treatment of animals by carriers or by persons or organisations using them for research or experimental purposes or for exhibition, or holding them for sale as pets.

#### Wildlife and plants

16 U.S.C. § 3372 makes it unlawful to import, export, transport, sell, receive, acquire or purchase fish or wildlife or a plant taken, possessed, transported or sold in violation of a law, treaty or regulation of the United States or of Indian tribal law. In interstate or foreign commerce the same acts are unlawful for fish or wildlife taken, possessed, transported or sold in violation of any state law or regulation or any foreign law, and for a plant in the circumstances that subsection sets out, including a law that protects plants or regulates their theft, taking from a protected or designated area, or taking without required authorisation. It is also unlawful to make or submit a false record, account or label for, or a false identification of, any fish, wildlife or plant in the circumstances the section states. A plant import declaration must contain the scientific name, including genus and species, the quantity including the unit of measure, and the name of the country from which the plant was taken. Do not take a penalty figure from this note.

#### Dogs, stock and cruelty

Dangerous-dog and menacing-dog declarations, stock-route and travelling-stock permits, and a prosecution for cruelty to an animal in a home are not in the findings of 7 U.S.C. § 2131. Check the state or municipal code and the notice. Do not use a New South Wales, Queensland or Victorian rule as the United States rule.

#### Veterinary complaints

A complaint about a veterinary practitioner is made to the state board under that state's practice statute. Do not use the Victorian Board's online complaint or the Australian Capital Territory form VP07.

- Do not apply the Prevention of Cruelty to Animals Act 1986 (Vic), the Companion Animals Act 1998 (NSW), the Animal Management (Cats and Dogs) Act 2008 (Qld), a Queensland stock-route permit, or an Australian wildlife-licence class as United States law.
- Do not let the tool decide that a procedure is prohibited, or draft a cruelty charge or a veterinary complaint.
