| How AI is used | From the dispute type the lawyer names, say whether the opened schedule treats that dispute as subject to costs, not subject to costs, or outside the pages opened. Do not state a dollar figure. |
| What the lawyer must review | The lawyer decides whether this dispute carries costs, before any claim is sent. Do not claim an internal review where the regulation says no costs are payable. Do not copy one scheme's no-costs list onto a claim in another scheme. Keep medical details in the firm's system. Apply ASCR rule 9, APP 11, and the Privacy Act notifiable-breach test. |

## Checking plan

**Whether costs are recoverable**

The tool matches the dispute to the opened schedule. The lawyer decides whether a costs claim can be made.

- What the AI does: From the dispute type the lawyer names, say whether the opened schedule treats that dispute as subject to costs, not subject to costs, or outside the pages opened. Do not state a dollar figure.
- What the lawyer does: The lawyer decides whether this dispute carries costs, before any claim is sent. An internal review is not claimed where the regulation says no costs are payable. Do not copy one scheme's no-costs list onto a claim in another scheme. Keep medical details in the firm's system. Apply ASCR rule 9, APP 11, and the Privacy Act notifiable-breach test.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. A matter SIRA marks as not authorised by Schedule 1 is not given a costs claim.
2. Legal services on an insurer internal review are not claimed where clause 23 applies.
3. An infant is not added as a ground for Commission permission. Section 8.10(4) states the two grounds that were opened.
4. The New South Wales list is not applied to a Victorian or Queensland claim.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
