| What the lawyer must review | Use Schedule 6 for a compensation matter and Schedule 7 for work injury damages. Do not quote a dollar from a schedule that was not opened. Reconcile any ILARS grant to the work it funds. Decide whether the worker pays a shortfall. |

## Checking plan

**New South Wales workers costs**

The tool sets out the schedule or grant the lawyer names. The lawyer decides the shortfall.

- What the AI does: From the schedule or grant the lawyer identifies, set out the scheme amount, the solicitor-client amount, and the difference. Do not bill the difference until the lawyer decides who pays it.
- What the lawyer does: Choose the schedule or the grant, and decide who pays any shortfall.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Clause 88 and Schedule 6 deal with maximum costs in compensation matters. Schedule 7 deals with work injury damages. They are not interchangeable.
2. Clause 90 is headed as costs not recoverable in certain workers compensation circumstances. The circumstances were not opened, so they are not stated.
3. Clause 133A is headed as maximum costs given by the Independent Review Officer under section 337(1)(d) of the Workplace Injury Management and Workers Compensation Act 1998.
4. The June 2026 ILARS Funding Guidelines were opened only as a contents list. That list refers to a grant of funding. The body did not extract, so no stage fee and no funding rule is taken from it.

## Notes

- The lawyer reads the guideline and the current schedule before charging the worker for work the grant or the schedule covers.
- Keep medical details in the firm's system. Apply ASCR rule 9 and APP 11, and check whether a Privacy Act 1988 (Cth) breach is notifiable.

## Practical guide

Jurisdiction: New South Wales. Workers compensation costs under the 2016 regulation, and an ILARS grant where one is made.

**Deliverable**: A reconciliation of the schedule or grant against the costs agreement.

**Inputs**

- Whether the matter is compensation or work injury damages
- Any ILARS grant the lawyer identifies
- The costs agreement

**Example**: Illustrative example: Damages work is costed on the compensation schedule. The lawyer moves it to Schedule 7 before anyone tells the worker there is a shortfall.

**Stop and escalate when**

- A stage fee is taken from the ILARS contents page.
- Schedule 6 is used for work injury damages.

Checked 2026-10-23.
