## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Costs, billing & litigation funding](https://ailawframework.com/obligations/costs-billing-and-litigation-funding.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the outcome, invoices and amounts recovered that the lawyer marks, set out professional fees, any uplift, disbursements, funding charges and the net sum. Do not send the statement. |
| What the lawyer must review | Settle the net sum before the client receives the statement. Keep fees, uplift, disbursements and funding charges on separate lines. Use the recovered amount the lawyer marks, not a percentage from the regulator. If the protocol applies, the recovered costs are the protocol amount. |

## Checking plan

**Victorian settlement statement**

The tool reconciles the marked figures. The lawyer settles the net sum.

- What the AI does: From the outcome, invoices and amounts recovered that the lawyer marks, set out professional fees, any uplift, disbursements, funding charges and the net sum. Do not send the statement.
- What the lawyer does: Check each line and approve the net sum before the client receives the statement.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Professional fees and any uplift under section 182 are separate from disbursements.
2. A litigation lender is repaid with interest and/or a premium, as the regulator describes, and only on the terms the lawyer marks.
3. The regulator's "usually 60 to 75 per cent" is a description of party-and-party costs. It is not the recovered amount unless the lawyer marks the figure actually agreed or ordered.
4. This statement uses the actual outcome. It is not the earlier costs estimate.

## Notes

- No half-of-settlement cap was in the Uniform Law sections opened.
- Keep medical details in the firm's system. Apply ASCR rule 9 and APP 11, and check whether a Privacy Act 1988 (Cth) breach is notifiable.

## Practical guide

Jurisdiction: Victoria. A personal injury settlement statement under the Uniform Law, and the TAC protocol where it applies.

**Deliverable**: A settlement costs statement for the lawyer to settle before the client receives it.

**Inputs**

- Outcome figures
- Invoices
- Amount recovered, as marked
- Any lender repayment

**Example**: Illustrative example: The draft inserts 70 per cent of the fees as the costs recovered. The lawyer replaces it with the sum in the settlement correspondence.

**Stop and escalate when**

- The 60 to 75 per cent description is used as the recovered costs.
- A line has no invoice, agreement or order behind it.
