| How AI is used | From the outcome, refunds, invoices and funding charges the lawyer marks, set out the section 347 inputs and a net sum. Do not send the statement and do not treat the Commission's description as the formula. |
| What the lawyer must review | Settle the net sum only after the section 347 inputs are checked. Keep funding interest out of disbursements. The pre-settlement estimate is a separate obligation. This statement uses the outcome. Do not replace the formula with the Commission's half description. |

## Checking plan

**Queensland settlement statement**

The tool reconciles the outcome and lists the cap inputs. The lawyer applies section 347 before the client is given a net sum.

- What the AI does: From the outcome, refunds, invoices and funding charges the lawyer marks, set out the section 347 inputs and a net sum. Do not send the statement and do not treat the Commission's description as the formula.
- What the lawyer does: Apply section 347 and approve the net sum.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The statement separates legal costs, additional amounts, disbursements, refunds and costs recovered.
2. Interest on a facility the practice recommended or facilitated is an additional amount. It is not part of D.
3. The Legal Services Commission says that before settlement of a litigious matter the practice must give a reasonable estimate of legal costs payable by the client, including other parties' costs. That estimate is a different task.
4. The Commission describes the cap as no more than half after refunds and disbursements. The lawyer still applies the section.

## Notes

- Claim-related costs are inclusive of GST and are the legal costs plus the additional amounts.
- Keep medical details in the firm's system. Apply the confidentiality duty and APP 11, and check whether a Privacy Act 1988 (Cth) breach is notifiable.

## Practical guide

Jurisdiction: Queensland. A personal injury settlement statement, tested against section 347 where the claim is speculative.

**Deliverable**: A settlement costs statement with the section 347 inputs shown.

**Inputs**

- Judgment or settlement
- Refunds
- Invoices and funding charges
- Costs recovered

**Example**: Illustrative example: The net sum treats loan interest as a disbursement and then halves what remains. The lawyer moves the interest into additional amounts and applies section 347.

**Stop and escalate when**

- The net sum is sent before the cap is applied on a speculative claim.
- The Commission's description is used in place of the formula.
