| Practice area | [Costs, billing & litigation funding](https://ailawframework.com/obligations/costs-billing-and-litigation-funding.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the facility the lawyer marks, draft the disclosure and say whether the interest is an additional amount under section 347. Do not send it. |
| What the lawyer must review | Settle the disclosure and any contract the client signs. Put recommended or facilitated funding interest in additional amounts, not in D. Do the same for interest on the practice's own facility. Do not treat barrister's fees after the relevant notice as additional amounts. |

## Checking plan

**Queensland funding disclosure**

The tool drafts the disclosure and tags the interest. The lawyer decides whether section 347 catches it.

- What the AI does: From the facility the lawyer marks, draft the disclosure and say whether the interest is an additional amount under section 347. Do not send it.
- What the lawyer does: Classify the interest and approve the disclosure before the client signs.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Additional amounts include interest or fees on a loan or credit facility obtained on the advice or recommendation of, or facilitated by, the practice, to fund disbursements.
2. They also include interest or fees the client pays the practice for use of the practice's own facility for that purpose.
3. D does not include additional amounts or interest on the disbursements. The Commission says that interest is treated as legal costs, not as a disbursement, for the maximum.
4. Section 323(3)(b) allows disbursements to be payable irrespective of the outcome. Barrister's fees after the relevant notice of claim are outside additional amounts in the cases section 347 lists.

## Notes

- The disclosure tells the client which charges are disbursements and which are additional amounts.
- Keep medical details in the firm's system. Apply the confidentiality duty and APP 11, and check whether a Privacy Act 1988 (Cth) breach is notifiable.

## Practical guide

Jurisdiction: Queensland. Disbursement funding on a speculative personal injury claim.

**Deliverable**: A funding disclosure that separates disbursements from additional amounts.

**Inputs**

- The facility terms
- Whether the practice recommended or facilitated it
- Whether a notice of claim has been given

**Example**: Illustrative example: The firm's overdraft funded the medico-legal reports. The draft calls the interest a disbursement. The lawyer tags it as an additional amount under section 347.

**Stop and escalate when**

- Funding interest recommended by the practice is left inside D.
- The client is asked to sign a facility that contradicts the disclosure.
