| How AI is used | From the funding terms the lawyer marks, draft the disclosure of who advances the disbursements, what the client must repay, and whether interest or a premium sits inside the speculative-claim cap. Do not send it. |
| What the lawyer must review | The lawyer settles the disclosure, and any funding contract the client signs. State who advances the disbursements, and whether interest or a premium is repayable. In Queensland, do not put that interest inside disbursements if it is an additional amount. Keep medical details in the firm's system. Apply ASCR rule 9, APP 11, and the Privacy Act notifiable-breach test. |

## Checking plan

**Disbursement funding disclosure**

The tool drafts the funding disclosure from the terms the lawyer marks. The lawyer settles it before the client signs.

- What the AI does: From the funding terms the lawyer marks, draft the disclosure of who advances the disbursements, what the client must repay, and whether interest or a premium sits inside the speculative-claim cap. Do not send it.
- What the lawyer does: The lawyer settles the disclosure, and any funding contract the client signs. State who advances the disbursements, and whether interest or a premium is repayable. In Queensland, do not put that interest inside disbursements if it is an additional amount. Keep medical details in the firm's system. Apply ASCR rule 9, APP 11, and the Privacy Act notifiable-breach test.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. The lender, the amount advanced, the interest or premium, and who must repay it are taken from the facility the lawyer marks.
2. In Queensland, that interest is tested as an additional amount under section 347, not as part of D.
3. Barrister's fees after the relevant notice of claim are not described as additional amounts unless the lawyer finds they fall outside the exclusion.
4. No funder cap is stated for Victoria or New South Wales beyond sections 181 and 182 and the terms of the facility.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
