## Checking plan

**Victorian advertisement check**

The tool marks the draft against rules 36.1 and 36.2. The lawyer decides what may be published.

- What the AI does: Compare the draft advertisement or webpage with rules 36.1 and 36.2 and list each statement or speciality claim the lawyer must decide. Do not publish it.
- What the lawyer does: Decide each line and approve the copy before publication.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The advertisement is not false, misleading or deceptive or likely to mislead or deceive, offensive, or prohibited by law.
2. The advertisement does not convey a false, misleading or deceptive impression of specialist expertise. The words accredited specialist, or a derivative including post-nominals, are not used unless the solicitor is a specialist accredited by the relevant professional association.
3. A no win, no fee line does not say there is nothing to pay if the client loses. The regulator says that is not what the agreement means.
4. No Victorian statute banning personal injury advertising, of the kind found elsewhere, was in the sources opened. Do not invent one.

## Notes

- Rules 36.1 and 36.2 were opened in the New South Wales compilation of the uniform conduct rules, current from 1 July 2026. They are the advertising rules for Victorian solicitors under that uniform scheme.
- The regulator's explanation of no win, no fee agreements is consumer guidance. It is not permission to advertise in a way rule 36 prohibits.

## Practical guide

Jurisdiction: Victoria. Advertising by a solicitor under the uniform conduct rules.

**Deliverable**: A marked advertisement with each passage flagged for the lawyer.

**Inputs**

- The draft advertisement, webpage or social post
- Any specialist wording

**Example**: Illustrative example: A webpage says the client pays nothing if the claim fails. The lawyer rewrites it, because disbursements and the other side's costs can remain payable.

**Stop and escalate when**

- Accredited-specialist wording is used and accreditation has not been checked.
- The draft says a failed claim costs the client nothing.
