## Checking plan

**New South Wales advertisement check**

The tool marks the draft against rule 36. The lawyer does not use the agent clause against a lawyer.

- What the AI does: Compare the draft with rules 36.1 and 36.2, and note if the publisher is an agent advertising a work injury service. Do not publish it.
- What the lawyer does: Decide each line, and whether the publisher is an agent or a lawyer.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Rule 36.1 is applied: not false, not misleading or deceptive or likely to mislead or deceive, not offensive, and not prohibited by law.
2. Rule 36.2 is applied to accredited-specialist wording and to any impression of specialist expertise.
3. Clause 73 of the Workers Compensation Regulation 2016 restricts an agent who advertises a work injury service. The maximum penalty is 200 penalty units. It does not bind a lawyer.
4. The current regulation has a division on advertising by persons other than agents or lawyers. Clause 80 itself was not opened, so its text is not stated.

## Notes

- Rules 36.1 and 36.2 are in the compilation current from 1 July 2026.
- Do not cite a repealed regulation that once restricted lawyers. The current clause 73 text was opened and it binds agents.

## Practical guide

Jurisdiction: New South Wales. Solicitor advertising under the uniform conduct rules, and agent advertising under the workers compensation regulation.

**Deliverable**: A marked advertisement, with a note on whether the publisher is an agent.

**Inputs**

- The draft copy
- Whether the publisher is an agent or a lawyer

**Example**: Illustrative example: A lawyer's work-injury webpage is rejected under clause 73. The lawyer reverses that. Clause 73 applies to an agent, not to a lawyer. Rule 36 still applies.

**Stop and escalate when**

- A lawyer's advertisement is failed under clause 73.
- Accredited-specialist wording is unchecked.
