## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Costs, billing & litigation funding](https://ailawframework.com/obligations/costs-billing-and-litigation-funding.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | From the retainer file the lawyer marks, list how the client came to the firm, whether any payment for a referral is recorded, and which costs agreement applies. Do not draft the certificate or the statutory declaration. |
| What the lawyer must review | The supervising principal writes and signs the certificate and the declaration. The tool lists facts from the file. It does not draft that declaration. A false or misleading certificate is an offence. Do not guess the source. Check a speculative agreement against section 71E or section 347. |
| Written for | Queensland |
| Applies to | [Assemble the retainer facts for the certificate that a claim was not claim farmed](https://ailawframework.com/obligations/costs-billing-and-litigation-funding/assemble-the-retainer-facts-for-the-certificate-that-a-claim-was-not-cla.md) |

## Checking plan

**Queensland certificate facts**

The tool lists retainer facts. The supervising principal writes and signs the certificate and the statutory declaration.

- What the AI does: From the retainer file the lawyer marks, list how the client came to the firm, whether any payment for a referral is recorded, and which costs agreement applies. Do not draft the certificate or the statutory declaration.
- What the lawyer does: Decide the facts, write the certificate and the declaration, and sign them.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The output is a fact list. It is not the certificate and not the statutory declaration.
2. The certificate is required when the practice is retained, at settlement or judgment, and if the practice is sold.
3. It covers sections 71 and 71B, and, if the claim is speculative, section 71E or section 347. If the principal believes section 71 or 71B does not apply because of subsection (3), the reasons are for the principal to write.
4. On a sale, section 8F requires a copy to the claimant. Workers claims are referred to section 325F of the Workers' Compensation and Rehabilitation Act 2003.

## Notes

- The Legal Services Commission says the certificate must be signed by the supervising principal and verified by a statutory declaration. Giving a false or misleading certificate is an offence. Claim farming, and failure to provide a certificate at the required stages, each carry a maximum penalty of 300 penalty units.
- The practice must refund or not recover fees and disbursements connected with a claim that has been claim farmed.
- The Queensland Courts generative AI page names Supreme Court Practice Direction 5 of 2025 and District Court Practice Direction 12 of 2025. Those PDFs were not opened. The non-lawyer guideline is not the practitioner rule.

## Practical guide

Jurisdiction: Queensland. A law practice certificate on a personal injury claim, given to the claimant and, where required, the regulator or the next practice.

**Deliverable**: A list of retainer facts. Not the certificate and not the statutory declaration.

**Inputs**

- How the client came to the firm, from the file
- Any payment connected with the referral
- The costs agreement, if the claim is speculative

**Example**: Illustrative example: The file does not record who referred the client. The tool leaves that field blank. The principal does not sign a certificate that guesses a self-referral.

**Stop and escalate when**

- The tool has drafted the certificate or the statutory declaration.
- The source of the client is an assumption rather than a file record.
