## Checking plan

**Incapacity approval figures**

The tool organises the costs figures and a chronology. The lawyer writes any document that is filed.

- What the AI does: From the invoices and the settlement figures the lawyer marks, set out the costs breakdown and a chronology of the funding. Do not draft the affidavit or the application that is filed.
- What the lawyer does: The lawyer writes anything filed for approval. The tool only organises marked figures. Check whether approval is required on the day the agreement is made. Reconcile any scheme partial payment. Do not invent a court rule that was not opened. Keep medical details in the firm's system. Apply ASCR rule 9, APP 11, and the Privacy Act notifiable-breach test.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.
- Restriction: The tool organises figures and a chronology. It does not draft the application, affidavit or other document that is filed.

## Checks the lawyer makes

1. The tool's output is not filed. The lawyer writes the application and any affidavit.
2. In New South Wales, the lawyer decides whether section 76(3A) removes the need for approval on the day of the agreement.
3. The Victorian protocol partial payment of $10,000 is only for the initial court approval, and is reconciled at final settlement.
4. In Queensland, a litigation guardian does not settle unless the court or the Public Trustee agrees. No rule number is added.
5. The lawyer checks the court direction on generative AI before any figure or citation is put into a filed document.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
