## Checking plan

**Source-by-source verification**

Mark a statement that both overreaches and misleads or intimidates, a threat of a complaint, and a tactic aimed at embarrassment.

- What the AI does: From the message the tool proposes to send, list any statement that asserts more than the client's position, any threat of a criminal or disciplinary complaint, and any line aimed at embarrassing or frustrating the other person. Do not send the message.
- What the lawyer does: The lawyer decides whether the statement grossly exceeds the client's rights and misleads or intimidates, and settles the message before it is sent.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. In any action or communication associated with representing a client, a solicitor must not make a statement to another person which grossly exceeds the legitimate assertion of the rights or entitlements of the client and which misleads or intimidates the other person.
2. The solicitor must not threaten the institution of a criminal or disciplinary complaint against the other person if a civil liability to the client is not satisfied.
3. The solicitor must not use tactics that go beyond legitimate advocacy and which are primarily designed to embarrass or frustrate another person.
4. The lawyer decides whether the message does any of those things. The marked list is not the message that is sent.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
