| How AI is used | From the description of the decision, list which subject the file names and whether the file says the system makes the decision or assists in it and can alter the outcome. Do not write the conclusion. |
| What the lawyer must review | The lawyer writes the conclusion. Section 6-1-1701(9)(a) defines a high-risk artificial intelligence system as one that, when deployed, makes, or is a substantial factor in making, a consequential decision. A consequential decision has a material legal or similarly significant effect on the provision or denial to a consumer, or the cost or terms, of education, employment, a financial or lending service, an essential government service, health-care services, housing, insurance, or a legal service. A substantial factor assists in making the decision, is capable of altering the outcome, and is generated by an artificial intelligence system. The definition also includes use of a system to generate content, a decision, a prediction, or a recommendation that is used as a basis for the decision. The lawyer decides whether an exclusion in section 6-1-1701(9)(b) applies. |

## Checking plan

- What the AI does: From the description of the decision, list which subject the file names and whether the file says the system makes the decision or assists in it and can alter the outcome. Do not write the conclusion.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- The text opened is the signed act of 17 May 2024. It is a Colorado statute. Consumer means a Colorado resident. Confirm it is still the text in force. No other state's automated-decision statute was opened.
- The federal definition of health-care services cited in the act was not opened. The exclusions for a narrow procedural task, anti-fraud technology, and the other technologies the subsection lists are applied by the lawyer from the act, not from this note.
