The New Zealand Law Society Te Kāhui Ture o Aotearoa runs practising certificates, the Lawyers Complaints Service and the trust-account Inspectorate. Conduct standards: the Conduct and Client Care Rules 2008. Section 4 sets fundamental duties, including upholding the rule of law and protecting client interests.

## What to open first

- For a court or tribunal document: the Courts of New Zealand lawyer guidelines (7 December 2023). Check the forum is on the list at the end of the PDF.
- The Law Society generative-AI guidance (March 2024).
- The Conduct and Client Care Rules that attach to your practising certificate.
- Do not apply an Australian court AI practice note to a New Zealand filing.

## Court and tribunal AI rules

- Courts covered: Supreme Court, Court of Appeal, High Court, District Court and listed specialist courts, including the Family, Youth, Employment, Environment, Coroners and Māori Land Courts.
- Tribunals covered: the Waitangi Tribunal and listed tribunals, including the Disputes, Tenancy, Immigration and Protection, and Human Rights Review Tribunals and the Taxation Review Authority.
- Chatbots are not search engines. The judiciary says they appear to have had limited access to New Zealand law and procedure.
- You are responsible for the accuracy of everything you file, including citations. Chatbots can invent cases and quotes, apply overseas law and confirm their own inventions.
- Generally enter nothing that is not already public. Never enter private, confidential, suppressed or privileged information. Report a suppression breach to the registry promptly.
- You need not disclose GenAI use unless the court or tribunal asks.
- Chatbots generally do not account for Māori and Pasifika cultural values and practices. Treat this as a bias risk.

## Professional-conduct rules

- The Lawyers and Conveyancers Act 2006 and the Conduct and Client Care Rules 2008 apply to tool use, including the duty not to mislead the court (r 13.1).
- Advice or work product from a tool is still your responsibility.
- Misuse can breach r 3 (competence), r 10.9 (misleading conduct) and r 13.1 (fidelity to the court). Supervision failures engage rr 11 and 11.1.
- Client or privileged material in a public tool may breach Chapter 8. Consider client consent. Test with fictional data.
- Tell the client, where appropriate, how a tool is used (rr 3.5 and 7.1). Review time-and-attendance billing.
- Complaints go to the Law Society's Lawyers Complaints Service.

## Privacy and confidentiality

- The Privacy Act 2020 applies to everyone using AI tools in New Zealand. Do a privacy impact assessment first and keep it current.
- IPP 12 applies when prompts or outputs leave New Zealand. Confirm where the vendor stores and processes data.
- The Commissioner expects leadership approval, a necessity review, plain-language transparency, engagement with Māori on taonga information, access and correction (IPPs 6 and 7) and human review.
- Do not enter personal or confidential information unless the provider has confirmed it will not retain or disclose it.
- IPP 3A (notification of indirect collection) has applied since 1 May 2026.
- Public-service guidance on digital.govt.nz advises against putting personal and client information into external AI tools.

## Review checklist

- Confirm the court or tribunal is covered by the 7 December 2023 guidelines.
- Check every output and citation in a trusted source, not another generative tool.
- Open each Act or rule on legislation.govt.nz; confirm the version at the material date.
- Keep private, confidential, suppressed and privileged material out of public tools. Turn off chat history where you can.
- Keep affidavits in the witness's words. No invented facts, witnesses or police testimony.
- Confirm supervised staff were authorised to use the tool and told their supervisor.
- Be ready to tell the court which parts used a tool and how they were checked.
- For personal information, record the privacy impact assessment and the IPP 12 position.

## Regulator and Law Society guidance

- Start with the Law Society AI Hub: the March 2024 guidance, the court PDF, the Privacy Commissioner's AI pages and National Cyber Security Centre material on agentic AI.
- The Law Society Library will check AI-generated case citations.
- The Hub's case-law list shows overseas decisions; New Zealand cases will be added. Do not cite a New Zealand fabricated-citation judgment you have not opened.

## Firm obligations that sit beside the file

- Trust accounts: Lawyers and Conveyancers Act 2006 ss 110–116 and the Trust Account Regulations 2008. Read the Law Society page and the 2024 Trust Accounting Guidelines.
- Barristers cannot operate a trust account or hold fees in advance, except through an instructing solicitor's trust account or escrow.
- Lawyers providing designated services are reporting entities under the AML/CFT Act 2009, supervised by the Department of Internal Affairs. Check the DIA page for current guidance.
- Customer risk-rating records have been required since 1 June 2025. A tool must not make the final CDD or SAR decision.
