## What this means for lawyers

Part 161 (22 NYCRR, effective 1 June 2026) does not ban AI in court papers and does not require you to tell the court you used it.

You are still responsible for the paper: under the model rule, review it carefully and independently check that it contains no fabricated or fictitious cases, statutes or other material. Signing certifies you did. Sanction or other remedial action is possible.

Individual New York judges may adopt their own part rule (the model rule or something different), so check the assigned judge's part rules before filing.

Bills in the 2025–2026 session (S2698, A8546, S9794) would require a separate affidavit disclosing generative AI use in civil papers. None has passed either house: S2698 and S9794 were committed to the Senate Rules Committee (13 June 2025 and 5 June 2026), and A8546 is in the Assembly Judiciary Committee.

As at 31 October 2026.

## Telling the court and the client

**Tell the court:** Varies by court

Court disclosure: no statewide requirement (Part 161 policy says disclosure should not be required), but depends on the individual judge's part rules. Client disclosure/consent: no rule found in the sources read. NYC Bar Formal Opinions 2024-5 and 2025-6 and the related 2026-2 (on AI for non-client conversations) were not read this cycle, so no answer is recorded from them.

**Tell the client:** Unclear
