## What this means for lawyers

In the federal District of Kansas, you must review and verify all AI-drafted or AI-assisted content in a filing (citations, quotations, paraphrased assertions, legal analysis, factual and procedural background), and may be sanctioned, including referral to disciplinary authorities, if you do not.

In Shawnee County District Court, if any part of a filing was drafted with generative AI, you must check it against print reporters, traditional legal databases or other reliable means, and mark the first page with a written disclosure and certification that it was checked. Effective 14 June 2024.

As at 31 October 2026.

## Telling the court and the client

**Tell the court:** Varies by court

Court disclosure: depends on the court. Shawnee County District Court: yes, whenever any portion of a filing was drafted with generative AI, in writing on the first page, to the court and opposing parties, with a certification it was checked. D. Kan.: only if a judge orders a sworn AI-use statement in the case. No statewide rule confirmed. Client disclosure/consent: no rule found (not confirmed from a primary source).

Applies to all lawyers and parties, including pro se litigants, filing in the federal District of Kansas. It does not impose a blanket AI disclosure rule. It reminds filers they remain responsible for the accuracy of anything filed, even if AI drafted or assisted, and must review and verify citations, quotations, paraphrased assertions, legal analysis and factual and procedural backgrounds. The court may strike filings and impose further sanctions, and has discretion to require a party in any case to include a sworn statement on AI use in all its filings.

Key points:

- Litigants must review and verify all AI-drafted or AI-assisted content, including citations, quotations and legal analysis.
- Possible sanctions include striking the filing with or without prejudice, monetary sanctions, referral of counsel to disciplinary authorities, disqualification, filing restrictions or dismissal of a party's case.
- The court has broad discretion to require a party in any case to include in all filings a sworn statement disclosing the extent of AI use, naming the AI tool, identifying AI-generated portions and/or certifying personal verification of each legal authority cited.
- The order remains in effect until further order of the court.
