## What this means for lawyers

The Illinois Supreme Court's AI Policy (announced 18 December 2024) says use of AI by litigants, attorneys, judges and court staff "may be expected, should not be discouraged, and is authorized" if it complies with legal and ethical standards.

The Rules of Professional Conduct (and, for judges, the Code of Judicial Conduct) apply fully to AI use, and attorneys, judges and self-represented litigants are accountable for their final work product.

All users must thoroughly review AI-generated content before submitting it in any court proceeding, and must understand both general AI capabilities and the specific tool before using it.

The Court said its current rules are sufficient to govern AI use and that it will regularly reassess them; the announcement does not describe a new disclosure or certification rule.

As at 31 October 2026.

The ARDC, as the Illinois Supreme Court's agent, says it aligns with the Court's Policy on Artificial Intelligence, which authorises lawyers to use AI so long as existing duties are met, including competence, confidentiality, supervision, candor and protection of sensitive information. The page links a nonbinding guide and Practice Resource Kit (sample notices, policies, a consent form and a terms-of-use checklist). It states that if ARDC material is inconsistent with the Court's Policy, the Policy controls.

Key points:

- Guide is described on the page as concise and nonbinding.
- Court's Policy governs if there is any inconsistency.
- Kit contents (sample notices, policies, consent form, Terms-of-Use checklist) are as described on the page; the guide itself was not read.
- Addressed to Illinois lawyers.
