# How to use AI for written submissions in Australia

> Written submissions can be drafted with a tool only inside the court’s rule, and every citation and quote is opened by a person before anyone signs.

## Check this before you rely on it

Hallucinated authorities have been put before Australian courts. The tracker linked from this guide is a list of those cases, not a practice note. The practice note still governs.

## Steps

1. **Draft only within the court’s rule.** SC Gen 23, GPN-AI, Supreme Court of Victoria Practice Note SC Gen 25 and NCAT Procedural Direction 7 do not say the same thing about drafting and about disclosure. SC Gen 25 replaced the May 2024 Victorian guidelines on 14 May 2026. Read the note that binds the proceeding. A submission in NCAT is not covered because you followed a Supreme Court habit.
2. **Verify every citation and every quotation.** Open each authority and each quote. SC Gen 23 requires the check to be done by a person, not by another generative tool. GPN-AI requires the authority to support the proposition, not merely to exist. A quote that is the wrong paragraph is a false citation even when the case is real.
3. **Add the disclosure or verification the note requires.** Where the note wants a statement that authorities have been checked, write it from the record of the check, not from a template. Where the note does not want routine disclosure, do not add a paragraph that suggests the court asked for one. NCAT Procedural Direction 7 is the NCAT text.
4. **A senior practitioner signs.** The practitioner whose name goes on the submission has read it and the check. The Uniform Law regulators’ statement and the cases collected on the hallucination tracker are the reason that signature is not a formality. If they have not opened the pinpoints, they do not sign.

## Questions

**Is it allowed to use AI for written submissions in Australia?**

Drafting assistance is commonly allowed. Filing unverified authorities is not. SC Gen 23, GPN-AI and NCAT Procedural Direction 7 each say what the check is.

**What tools are used for written submissions?**

Research tools in this catalogue, such as Lexis+ AI, Habeas and JADE, can help find authorities. They do not verify them. The verification is opening the case.

**What if a case in the draft does not exist?**

Remove it. Do not explain it away in a footnote. Courts have treated invented citations as a failure of the practitioner, including where a junior or a client produced them.
